BBradyImages | Terms and Conditions
1. Ownership and Copyright
All photographs, videos, and media (the "Images") produced by BBradyImages are the sole property of BBradyImages. Copyright of all media remains with the photographer. The Images may not be resold, leased, or gifted to any third party (including builders, stagers, or other agents) without the express written permission of BBradyImages.
2. Usage License
Upon full payment, the Client is granted a limited, non-transferable license to use the Images for the marketing of the specific property listed.
Duration: This license is valid for the duration of one (1) listing and expires one year from the original photography date.
Re-listing: If the property is re-listed after one year, or listed with a different brokerage, a new license must be purchased.
Marketing Rights: BBradyImages reserves the right to use any Images for the purpose of self-promotion, including use on websites, social media, and professional portfolios.
3. Delivery and Turnaround
Standard Delivery: Photos are guaranteed to be delivered via electronic transfer within 24 hours of the completion of the shoot.
Expedited Delivery: Any delivery required in less than 24 hours must be requested and agreed upon at the time of the photography session. Additional fees may apply for rush services.
4. Cancellations and Rescheduling
Notice Period: We understand that real estate is fast-moving. However, we require at least 48 hours' notice for cancellations or rescheduling.
Cancellation Fee: Cancellations or rescheduling requests made with less than 48 hours' notice may incur a $35.00 fee.
Weather: BBradyImages reserves the right to reschedule in the event of inclement weather that prevents safe equipment operation (e.g., heavy rain, high winds for drone flights).
5. Limitation of Liability
Property Condition: The Client is responsible for ensuring the property is "photo-ready" at the time of the appointment. BBradyImages is not responsible for moving furniture, cleaning, or staging.
Legal Liability: BBradyImages shall not be held liable for any damages, loss, or injury sustained at the property during the shoot. The maximum liability for any claim, including negligence or breach of contract, shall be limited to the total amount paid by the Client for the specific service provided.
6. Payment Terms
Payment is due upon receipt of the final images unless otherwise agreed upon in writing. BBradyImages reserves the right to withhold or remove images if payment is not received in a timely manner.
7. Drone and Aerial Operations
Compliance: All drone operations are conducted by an FAA Part 107 certified pilot. Operations are strictly subject to all Federal, State, and Local laws and regulations.
Restricted Airspace: Flight in restricted or controlled airspace is subject to authorization from the FAA (LAANC or COA). This process is dictated by the authorities; restrictions cannot be circumvented for any reason. If a property is located in a "No Fly Zone" or if authorization is denied, BBradyImages will notify the client, and that portion of the service will be canceled or modified.
Weather Conditions: Aerial services are weather-dependent. BBradyImages reserves the right to reschedule or cancel drone flights due to high winds, precipitation, or other atmospheric conditions that compromise safety or equipment integrity.
8. Safety and Site Conduct
Right of Refusal: BBradyImages reserves the right to cancel, reschedule, or alter services on-site based on the safety of the photographer. This includes, but is not limited to:
The presence of unrestrained or aggressive pets.
Potentially unsafe or hazardous property conditions.
Hostile or threatening environments.
Illegal Activity & Trespassing: BBradyImages will not engage in any illegal acts. This includes trespassing on neighboring properties to achieve specific angles. If a client requests an operation that is illegal or violates safety protocols, the photographer will refuse the request, and the shoot may be subject to immediate cancellation.
Liabilities: The client assumes all responsibility for notifying residents or neighbors of the scheduled photography and ensuring legal access to the property.
